Terms and Conditions (T&C)
§1 Scope
These Terms and Conditions apply to all business relationships between [Your Company] (hereinafter "Provider") and its customers in the respective version valid at the time of contract conclusion.
§2 Subject Matter of the Contract
2.1 The subject of the contract is the provision of a digital menu as a one-time purchase.
2.2 The scope of functions includes:
- Unlimited menu updates
- An individual QR code
- Mobile optimization
- One-time payment without additional monthly costs
§3 Contract Formation
3.1 The presentation of products in the online shop does not constitute a legally binding offer.
3.2 The contract is formed through the acceptance of the customer's order by the provider. Confirmation will be sent via separate email.
§4 Prices and Payment
4.1 All prices are in Euro and include statutory VAT.
4.2 Payment is exclusively processed through the payment service provider Stripe.
§5 Service Delivery
5.1 Access to the digital menu will be activated immediately after successful payment.
5.2 The provider is entitled to further develop and adapt the technical implementation of the services.
§6 Right of Withdrawal
6.1 The right of withdrawal expires for digital content when the provider has begun executing the contract after the consumer has:
- expressly agreed that the provider begins executing the contract before the withdrawal period expires, and
- confirmed their knowledge that they lose their right of withdrawal when the contract execution begins.
§7 Liability
7.1 The provider has unlimited liability for intent and gross negligence.
7.2 For slight negligence, the provider is only liable for breach of essential contractual obligations and limited to foreseeable, typical contractual damage.
§8 Data Protection
The collection and processing of personal data is carried out in accordance with our Privacy Policy.
§9 Final Provisions
9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
9.2 Should individual provisions of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
